Our Commitment to the environment extends beyond the design and deployment of environmentally friendly products. It also addresses the responsible management of the technology and equipment at the end of its life cycle through utilization of environmentally responsible processes. These processes reduce negative impact to the environment, and also meet the requirement of regulations such as the European Unions Waste Electrical and Electronic Equipment (WEEE) Directive. Avaya employs a number of end of life management strategies around the world such as collective e-waste take back schemes in the EU and our own Authentic Avaya program in North America. What is the WEEE Directive? The Waste Electrical and Electronic Equipment (WEEE) Directive is a European Union Directive, which was introduced to promote the collection and environmentally sound management (disposal) of WEEE by the "producer" where the "producer" is defined as: • a company that manufactures and sells Electrical and Electronic Equipment (EEE) under their own brand; • a reseller of EEE produced by other suppliers under their own brand; • an importer or exporter of EEE on a professional basis into a member state. Together with its twin directive, the RoHS Directive, the WEEE Directive became law in Europe in February 2003 and today, sets collection, recycling and recovery targets for WEEE across the EU. The WEEE Directive requires that "producers" take responsibility for the financing, treatment, recovery and disposal of WEEE arising from the sale of equipment on or after the 13th August 2005. Additionally, if the sale of equipment results in the disposal of old or legacy equipment, which is termed "historic" WEEE, then the "producer" is responsible for the financing, treatment, recovery and disposal of "historic" WEEE associated with this legacy product. In the case of "historic" WEEE where no replacement is purchased, the customer is responsible for the disposal of the WEEE. Avaya’s Commitment Avaya is committed to minimizing the environmental impact of our products by using environmentally-focused policies and practices in the design, manufacture, support and disposal of our solutions. What Avaya Customers Can Expect For direct sales to customers of equipment that came to market after the 13-August 2005, the customer is responsible for returning the WEEE to Avaya at their cost and Avaya will then dispose of the WEEE in accordance with the applicable legislation. Avaya will also dispose of "historic" WEEE on a one-for-one basis, provided the customer's "historic" WEEE is replaced with Avaya EEE. Indirect sales to customers (i.e. Business Partners (BP), distributors and resellers) fall into two categories as follows: • if the BP, distributor or reseller resides in a particular EU member state and sells Avaya EEE to a third party, which resides in the same EU member state, then the BP, distributor or reseller, as importer of the EEE into the EU member state, is viewed as being the "producer" of the EEE and by law is responsible for the take back and the disposal of WEEE; • if the BP, distributor or reseller resides in a particular EU member state and sells Avaya EEE to a third party, which resides in a different EU member state than the BP, distributor or reseller, then the third party, as importer of the EEE into the different EU member state is viewed as being the "producer" of the EEE and by law is responsible for the take back and disposal of WEEE. In countries where Avaya is part of an individual take back scheme (e.g. in Austria, France, Germany and Ireland), the BP, distributor or reseller is responsible for returning the WEEE to Avaya at their cost and Avaya will then take responsibility for the disposal of the WEEE in accordance with the applicable WEEE legislation. It should be noted that: • the default is for Avaya's customers to contact the appropriate in-country Avaya representative before contacting the disposal company regarding the disposal of WEEE; • third parties should contact their suppliers and not Avaya in relation to WEEE generated by indirect sales. Avaya only deals with disposal companies that are able to demonstrate that product disposal is conducted in a WEEE-compliant manner. Authentic Avaya In keeping with the philosophy of the WEEE legislation and the 3 Rs (Reduce, Reuse and Recycle), the Authentic Avaya program, which was launched in the U.S. in October 2004 and is now operational in Canada as well as all fifty U.S. states, extends the product life cycle of legacy products by offering to buy-back Avaya‘s customer‘s legacy products. This initiative relates to more than one thousand five hundred unique products, which includes the following: - Definity systems - Partner - Merlin Legend - Magix - Avaya telephones including CallMaster - Various circuit packs and controllers Authentic Avaya has a buy-back programfor our customers, in which the products come from many sources. They can be new, discontinued or surplus customer equipment. The buy-back initiative results in the responsibility for take back and environmentally responsible deposal of the products being transferred to Avaya when the products cannot be re-used. The buy-back program also benefits Avaya‘s customers by paying the customers for equipment they are unlikely to use in the future. As part of the Authentic Avaya program‘s second initiative, the certified refurbishment initiative, equipment that is bought back is then tested and repaired or re-manufactured as necessary to Avaya‘s standards. It is then sold as either spares or maintenance parts or for use in system expansions, which is in keeping with the requirements of the RoHS directive and extends the product life cycle of legacy products in the field. The refurbished equipment is covered under parts replacement warranty for a period of one year from its date of sale. The final Authentic Avaya initiative, the trade-in / trade-up program, offers customers the opportunity of trading- in and receiving credit for their old Time Division Multiplex (TDM) type equipment, which was originally supplied by Avaya, Nortel, Cisco or Siemens and replacing it with Avaya‘s IP telephony.
