Type of scheme in place: Collective take back scheme. Direct sales: On notifying Avaya, the customer is obliged to return the WEEE to the recycling facility nominated by Avaya at their cost , as defined by the local implementation of the WEEE Directive (2002/96/EC). Avaya will arrange for the disposal of this WEEE in accordance with the applicable legislation. Indirect sales: The Business Partner (BP), distributor or reseller is responsible for registering as an Electrical and Electronic Equipment (EEE) producer with the local authority, in accordance with the local implementation of the WEEE Directive (2002/96/EC). Indirect sales to customers (i.e. Business Partners (BP), distributors and resellers) falls into two categories as follows: if the BP, distributor or reseller resides in Poland and sells Avaya EEE to a third party, which resides in Poland, then the BP, distributor or reseller, as importer of the EEE into Poland, is viewed as being the "producer" of the EEE and by law is responsible for the take back and the disposal of WEEE;
if the BP, distributor or reseller resides in a particular EU member state other than Poland and sells Avaya EEE to a third party, which resides in Poland, then the third party, as importer of the EEE into Poland is viewed as being the "producer" of the EEE and by law is responsible for the take back and disposal of WEEE.
