E911 Apps - The Good - The Bad - and the . . . .
Over the past year, several new Apps have been released that are targeted at smart phone users to aid them with providing additional information about a particular emergent event to public safety. Although a noble initiative, the fact remains that public safety uses an analog-based voice only backend infrastructure that is only capable of carrying a voice call.
Before any data can be sent from one device to another, the Layer 1 transport infrastructure must exist between the two devices to support data. I'm sure that there are some of you that still remember when IVR and voice mail first came out in the mid-80s. At the time, there was actually a fair amount of rotary dial phones still in use that were unable to "Press one for customer service."
If the existing network won't support direct communications, and data, from smart phones today then how do these applications really work, and what's behind him? To answer that question, will have to create different categories for the applications themselves.
Category 1: Application developers that work closely with public safety
The public safety technical community is made up of a group of industry experts, manufact urers, public safety officials and public safety dispatchers and call takers. These individuals participate in technical forums managed by The National Emergency Number Association (NENA), the Association of Police and Communications Officials (APCO) as well as the NG9-1-1 Institute. Two developers in particular, Smart911 by Rave Mobile Safety, and the FRESS Social Network for Emergency Response by the FRESS (pronounced 'fresh') Foundation are very active in the industry.
In addition to supporting public safety initiatives in general, their work and participation/contribution to the standards bodies is invaluable. They understand public safety application requirements like high-availability, resiliency and protection against DoS attacks. They also understand and respect the funding model for both public safety end-user and the public end-user where the application is provided to the general public at no charge.
Category 2: The dude that writes Apps
Unfortunately today, anyone with a computing platform, some extra time on their hands, and a few dollars can invest in the software tools required to write a smart phone application. Even if you have none of that, with only a few dollars invested in an offshore programmer, you can deliver an application fairly easily. Come up with a nice logo, but a little marketing spin on the application, and you're in business! Take your cut of the $.99, and you can put a lot of money in your pocket in a fairly short period of time.
If you been reading my blog, you'll know that I brought up this fact a few times with applications like Crime Push, that seemingly allows you to collect pictures and other data, but then tells you that none of this can be sent to the 911 center but offers you a speed dial key for 911.
This past week, the NENA 911 related e-mail listserve became very active when a company (911 Emergency Assist) sent letters to 911 centers in the US promoting their vision for enhanced services. Their service required a paid subscription by the end-user, however they touted that a "donation" of $.50 per user would be given to 911 centers. Many administrators became alarmed at the potential legality of an arrangement such as that, as well as concerned for the "appearance of endorsement for a 'for-profit' private sector product".
Admittedly, that's a very fine line to walk, but several companies have been successful, mainly because they contribute to the industry first, and rarely promote their products.
If there's one thing that's obvious, next generation emergency services, for 911 here in the US and 112 abroad in the EU, are changing the landscape of what can be done to radically improve public safety response and increase situational awareness between the user that needs help, and the agency that can provide that help.
If we've learned one thing over the past 20 years of IT technology advancements, it's been how to use technology to increase efficiency in the networks we use to deliver advanced forms of data. There is nothing new or bleeding edge about the technology behind next generation emergency services. What is new, however, is the USE of this technology FOR emergency services.
Kudos to everybody in category 1, not only are you improving the technical functionality of the emergency services network, you're doing it in a way that is not being considered as "profiteering". For the rest of you in category 2, this past week should have made it perfectly clear that public safety won't stand for "marketing tactics" and the impact it can have on your brand could be devastating.
My advice to those that believe they have technology expertise to contribute to this industry; the first thing you should do is join NENA, APCO as well as the NG9-1-1 Institute. Secondly, watch and learn the industry to understand how it works, and what is needed. Third, at least one person, if not several, in your company needs to earn their NENA ENP certification, which is a litmus test indicating you understand the business behind public safety. Finally, participate and contribute to the various workgroups and technical committees where you can air your ideas in an open forum with technology leaders from around the world.
The water's great! Come on in! Just make sure you know how to swim.
As a followup, the letter below was sent to 911 EMERGENCY ASSIST by NENA:

July 2nd, 2012
Dear Mr. Torgler:
I have been informed by a number of NENA members that their PSAPs received communications from your company inviting them to activate accounts your company has pre-established for their centers. In exchange for activating these accounts, your company represents that it will "donate" 50¢ per local subscriber per month to each participating PSAP, and that it will provide participating PSAPs with access to a database containing subscriber-provided personal information such as emergency contact instructions and medical data. In addition, your marketing materials represent that your product will allow "911 dispatchers" to contact emergency contacts such as parents or friends.
Please understand that NENA does not endorse commercial products or services. When requested by our membership, NENA may propound questions to companies such as yours so that we can act as a clearinghouse for information that broadly affects PSAP operations. With respect to your service, "911 Emergency Assist," we have concluded that PSAPs would benefit from further information in regard to five specific issues: liability, training, consumer marketing, PSAP marketing, and the propriety of accepting what you describe as "donations" in exchange for participating in your company's service. The paragraphs that follow detail our concerns and questions. We would appreciate a prompt response, and will be happy to pass along your answers to our members.
First, our members have expressed concern that participating in your service could expose 9-1-1 authorities, PSAP managers, and telecommunicators to civil liability in the event that they utilize, fail to utilize, or improperly utilize your service. Your marketing materials describe a contractual or quasi-contractual relationship between public safety agencies and your company in which agencies receive "donations" in exchange for activating accounts with, accepting additional data from, performing tasks for, and promoting your company. Nowhere in your publicly-available collateral, however, do you make available the terms under which PSAPs undertake these obligations. For example, you do not make available the terms under which your company will defend, insure, indemnify, and otherwise protect against liability agencies or agency employees who use your service. NENA's members would appreciate your disclosure of any and all terms of service, agreements, etc., particularly including any terms that may expand, limit, or otherwise impact the liability of your company or agency users of your service (including their employees, agents, contractors, and assigns) for harms suffered by consumers.
Second, although your website and marketing collateral include references to training materials, those materials are not available for download. Your collateral implies that these materials may only be accessed from within a pre-created agency account. Many agencies, however, are unwilling to access these accounts because of the possibility that doing so would make them party to an agreement with your firm, the terms of which are not disclosed in advance, and the possibility that doing so could subject them to expanded liability on the basis of use, non-use, or improper use of your service with no guarantee of liability protection from your company. In order to evaluate any product or service offered in the marketplace, PSAPs and 9-1-1 authorities must have unfettered access to training materials. NENA's members would therefor appreciate your disclosure of the training materials your company has prepared for use by participating agencies.
Third, certain marketing representations your company makes on its public websites and mail collateral imply the coming availability of your service without qualification as to time, geographic scope, or agency participation. Other representations concern technical aspects of the functioning of wireless and VoIP E9-1-1 service in terms that are arguably confusing or inaccurate. NENA's members are concerned that such representations have the potential to mislead the public into believing that your service will function as-advertised even in areas where relevant agencies decline to utilize your service, and that other representations could mislead the public as to the hard-won capabilities of Phase I and Phase II wireless E9-1-1 service. Our members would appreciate an explanation of how your company intends to market the 911 Emergency Assist product so as to avoid consumer confusion as to the availability and functionality of your service in each jurisdiction or PSAP service area, and as to the capabilities of existing E9-1-1 systems.
Fourth, other marketing representations your company makes in collateral materials mailed to PSAPs arguably imply that an agency, PSAP, or jurisdiction has already agreed to participate in your service and need only activate its account to begin receiving benefits offered by your company. In concert with our members' grave liability concerns and the issues noted above with respect to a lack of publicly-available contract and training information, these representations raise questions about the legitimacy of your company. NENA's members would appreciate an explanation of how your company intends to market the 9-1-1 Emergency Assist service so as to avoid confusion on the part of state agencies, 9-1-1 authorities, and PSAPs that could lead to unintended consequences such as the assumption of liability for non-use or misuse of your service.
Finally, your marketing representations indicate that your company will pay to participating PSAPs 50¢ per month for each subscriber within the jurisdiction served by that PSAP, and describe a marketing model in which public safety agencies recommend or otherwise publicize the 9-1-1 Emergency Assist service to the public. Although you characterize these payments as "donations," it is unclear why they would not qualify as contract payments under the model you describe. In addition, your marketing materials make no reference to varying state laws concerning whether and under what circumstances public agencies may accept payments from private companies in exchange for providing a service to third-party subscribers. Our members would appreciate your disclosure of the legal research developed by your company to support the characterization of payments to public entities as "donations," and to support the propriety of your business model in each jurisdiction where you intend to offer service.
When we spoke by phone, you indicated your company's willingness to work with the 9-1-1 community to address our members' concerns. I look forward to your response. As indicated, I will share the materials you make available with NENA's membership. Should additional questions arise, I will forward them for your consideration.

Why is it that every developer thinks that since they can write code that they understand the back end industry of what they are coding. I am getting fed up by all of the "Emergency Apps" that are springing up. From what I can see they are all proprietary in the way they talk to the back end. So that means the 911 guy is going to have a hundred different Apps on his side?
Posted 1 Jul 2012 at 11:41 PMFrom what I remember, when CB radios came out, the police monitored channel 9, not all 40 of them. When are the app folks going to get smart and come up with a common backend that will talk to ANY client. WAKE UP CODE JOCKEYS! And stop eyeing up the 911 space as virgin new territory to sell your wares.
This is where the industry (NENA / APCO) need to step up and create standards; publish those standards; maintain those standards. That will provide the PSAP with guidance for RFP and RFI writing, and define the functionality for the private sector to build too.
Will it completely stop the problem? No, but it will provide a promulgated approach defined by the users that are impacted. This recent 'marketing event' has increased visibility and awareness of the problem. I would expect to see action in the very near future. Thanks for the comments.
